When you submit an item into ScholarWorks@UMBC, you’ll be asked to agree to the below license. If you’re the copyright holder, or the official agent of a UMBC unit that owns the copyright, you can agree to the license.

By signing and submitting this agreement, I am attesting that one of the following are true:

  1. This submission consists solely of links. Therefore, copyright law is not applicable.
  2. This submission was authored by an employee of the federal U.S. government in the scope of their job. Therefore, copyright law is not applicable.
  3. This submission is published on a Creative Commons license, and this submission abides by that Creative Commons License’s terms.
  4. I have written authority from the owner of the copyright to grant this license to UMBC and to apply any Creative Commons license applied to it.
  5. I represent that I am the sole or joint owner of the entire copyright, and I grant The University of Maryland, Baltimore County (UMBC) a no cost, nonexclusive, right and license to include the scholarly material identified below in the Digital Repository at UMBC, a part of MD-SOAR (The Maryland Shared Open Access Repository), or another Digital Repository system that UMBC may in the future utilize in the place of MD-SOAR, and through the Digital Repository at UMBC, to reproduce, publicly display and distribute the material at no cost to users world. If the material is based on work that was sponsored or supported by an agency or entity other than UMBC, I represent that I complied with any requirements the sponsor may have imposed on publication including a right of review or inclusion of an acknowledgement of its support. I attest that I understand the terms of any Creative Commons License that I applied to this submission and the rights that it gives to third parties. I attest that I understand that Creative Commons licenses are irrevocable.

 

I understand that if I wish to publish the material with a third party that requires me to assign to it all my rights in the material, I may direct UMBC to remove the material from the Digital Repository at UMBC. In such an event, I understand that a bibliographic reference to the material will be retained in the Digital Repository at UMBC, but the material will be removed to a "dark archive" that is not publicly accessible. I understand that if I applied a Creative Commons license to the work, it’s irrevocable, and 3rd parties may have reproduced it and may be distributing it. UMBC is not responsible for removing the work from 3rd party sites or any other actions attempting to regain the rights given to 3rd parties via a Creative Commons License.

This agreement will be interpreted and governed in accordance with applicable Federal law and the laws of the State of Maryland without reference to its conflict of laws rules.

Use this printable version of the license to obtain permission to include the item in ScholarWorks@UMBC by having the copyright holder sign it.  You'll also need to agree to the license during the submission process. You can include the signed license agreement with your submission, or send it to scholarworks-group@umbc.edu. If you’re unable to scan the signed license, send it to Michelle Flinchbaugh in the Library via campus mail.
